User Agreement

Introduction

Welcome to emqrc.com ("the App"). By accessing or using the App, you agree to be bound by this User Agreement ("Agreement"). If you do not agree to these terms, please do not use the App.

1. Description of the App

emqrc.com is a web-based application that allows users to generate a "unique" QR Code containing confidential medical information, which can be accessed by third parties who scan the QR code. The App offers two payment options:

• Free Version: Sponsored by Advertisers
• Paid Version: A yearly renewable fee of $4.99 with NO advertising.

2. User Responsibilities

• Confidential Information: By using the App, you acknowledge that you are voluntarily providing confidential medical information. You are solely responsible for ensuring the accuracy and completeness of this information.
• Authorization: You authorize emqrc.com to display the provided medical information when a third party scans the QR code. You acknowledge that the QR code may be scanned by any individual with access to the QR code.

3. Privacy and Data Use

• Authorization: You authorize emqrc.com to display the provided medical information for a third party access to scan your QR code in a "lost your cell situation" or a vital medical emergency. You acknowledge that the QR code may be scanned by any individual with access to the QR code and immediately an email will be generated to you identifying who it was.
• Advertising: If you choose the “free version” of the App, you agree to display both an EMQRC and an advertising QRC. These advertisements may be targeted based on your usage of the App.

4. Disclaimers

• No Medical Advice: The App is not intended to provide medical advice, diagnosis, or treatment. It is solely the information you have provided on the App for first responders or a “Good Samaritan” It is intended for informational purposes, rescue and emergency situations only and should not be relied upon in place of professional medical advice. We suggest checking and/or updating periodically your emergency information.

5. Payment and Refunds

• The $4.99 fee for the "ad-free" version of the App is auto-renewable on the anniversary date of initiation unless cancelled, and is non-refundable, non transferable. By making this payment, you agree that no refunds will be issued for any reason.

6. Termination

emqrc.com reserves the right to terminate or suspend your access to the App at any time, with or without notice, for any reason, including but not limited to violation of this Agreement.

7. Governing Law

This Agreement shall be resolved under the venue and jurisdiction of Miami-Dade County, Florida Courts. Any disputes arising out of or relating to this Agreement shall be resolved in the aforesaid mentioned.

8. Changes to the Agreement

We may update this Agreement from time to time. Any changes will be posted on this page with an updated "Effective Date." Your continued use of the App after any changes signifies your acceptance of the new terms.
